Chapter 8: The Father Who Wanted Custody

I read the message three times.

Mark is preparing to file for emergency custody.

My first instinct was to call him.

My second was to throw my phone against the wall.

Rachel took the device from my hand.

"Don't respond.""

I paced the living room.

"He's going to tell a judge I'm unstable?""

"That's what the message claims.""

"He watched his sister slap our daughter!""

"I know.""

"And now he's going to use the fact that I slapped her back?""

Rachel placed the phone on the table.

"Chloe, listen to me. We need to separate what we know from what we're afraid might happen.""

I stopped pacing.

"What do we know?""

"We know he has been discussing custody with someone. We know he has documents involving Lily. And we know he's already used your signature without permission.""

I looked at her.

"What do we do?""

"First, we document everything. Second, we establish a safe and consistent routine for Lily. Third, we prepare a response in case he files anything.""

I sat down.

"Can he really get emergency custody?""

"That depends on the evidence and the circumstances. His allegations alone don't automatically establish that.""

I nodded.

Then I whispered:

"I can't lose her.""

Rachel reached across the table.

"You won't face this without help.""

The next morning, I took Lily to preschool.

She was unusually quiet.

While I fastened her seat belt, she looked at me.

"Mommy?""

"Yes, sweetheart?""

"Is Daddy coming to my school?""

I froze.

"Why?""

"He told me yesterday that he might pick me up one day.""

I looked at her carefully.

"When did Daddy tell you that?""

"On the phone.""

I hadn't known Mark had called her.

"What else did he say?""

She played with the rabbit's ear.

"He said I might sleep at Grandma's house.""

My stomach tightened.

"Did he say why?""

She shook her head.

Then she looked up.

"Am I going to have two homes?""

I forced myself to smile.

"Mommy and Daddy are working through some grown-up problems. You don't have to worry about those.""

She nodded.

"But I don't want to sleep at Grandma's.""

I kissed her forehead.

"You don't have to decide anything right now.""

She wrapped her arms around me.

"Can I stay with you?""

"Always, sweetheart.""

I knew that wasn't a legal promise I could make.

But it was the promise I needed her to hear.

At 11:30, Rachel called.

"Chloe, Mark's attorney contacted me.""

I sat down.

"What did he say?""

"He's requested an emergency custody hearing.""

My chest tightened.

"Already?""

"Yes. He's alleging that your response at Thanksgiving demonstrates poor emotional control and that you've been interfering with his relationship with Lily.""

I laughed in disbelief.

"Interfering? He barely asks about her.""

"Do you have records of his contact with her?""

"Yes. Messages. Calls. Everything.""

"Good. Save them.""

I looked at the wall.

"What about the slap?""

"We need to be honest about it. You struck Megan. We won't pretend otherwise.

But the circumstances matter. Lily was struck first, and you reacted immediately to protect her. We'll present the entire sequence, not the isolated moment Mark wants people to see.""

I nodded.

"Can I show the court the recording?""

"Possibly, subject to the applicable rules and authentication. We'll discuss that with the appropriate attorney.""

I hesitated.

"Rachel, there's something else.""

"What?""

"Lily told me Mark said she might stay with Linda.""

Rachel became quiet.

"Did he say that directly to Lily?""

"Yes.""

"Tell me exactly what she said.""

I explained.

Rachel sighed.

"That concerns me. Children shouldn't be placed in the middle of adult disputes.""

I looked toward the hallway.

"He's already doing it.""

At 2:15 p.m., I received a call from Mark's attorney.

His name was Andrew Collins.

"Mrs. Bennett, I'm calling regarding the proposed custody arrangements.""

I put the call on speaker and opened my notebook.

"Go ahead.""

"Mr. Bennett is concerned about your recent behavior.""

"Which behavior?""

"Your physical confrontation with his sister.""

"His sister struck our five-year-old daughter.""

"That's a separate matter.""

"No, it isn't.""

He paused.

"Mr. Bennett would prefer to resolve this amicably.""

"Then he can stop threatening to take our daughter.""

"Nobody is threatening you.""

"Then why did he tell Lily she might have to sleep at her grandmother's house?""

Another pause.

"I wasn't aware of that conversation.""

"Now you are.""

He cleared his throat.

"Mr. Bennett is also concerned about your access to confidential business documents.""

I almost laughed.

"Documents bearing my forged signature?""

"Those are allegations.""

"Then perhaps your client should explain why my name appears on agreements I never signed.""

His tone became noticeably colder.

"I suggest you discuss financial matters separately from custody.""

I looked at the notebook.

"Your client is the one connecting them.""

The call ended shortly afterward.

I immediately forwarded the call details to Rachel.

That evening, Megan called.

I nearly ignored it.

But something made me answer.

"Hello?""

"Chloe?""

Her voice sounded strained.

"What do you want?""

"I need to tell you something about the custody filing.""

My stomach tightened.

"Go ahead.""

"Mark has been preparing it for weeks.""

"How do you know?""

"Because I helped him collect the documents.""

I closed my eyes.

"What documents?""

"Photographs. Statements. Medical records.""

I frowned.

"Medical records?""

"From Thanksgiving.""

I sat upright.

"What?""

Megan took a shaky breath.

"After you slapped me, Mom took me to an urgent care clinic. Mark asked for a copy of the report.""

I stared at the wall.

"He wants to use your cheek injury against me?""

"Yes.""

"Did you tell him what happened first?""

Silence.

"Megan?""

"No.""

I felt anger rising.

"Why?""

"Because Dad told me not to complicate things.""

I laughed bitterly.

"Your family really does have an answer for everything.""

"I know.""

She began crying.

"Chloe, I'm sorry.""

I didn't respond.

"I know I don't deserve forgiveness. But I need you to understand something. Mark wasn't the one who suggested the custody case.""

"Who was?""

Megan hesitated.

"Linda.""

I felt my stomach drop.

"Your mother?""

"Yes. She said if you refused to sign the trust agreement, they needed another way to make sure you couldn't interfere.""

I gripped the phone.

"Why would custody help them?""

"Because they thought you'd be more willing to sign if you were afraid of losing Lily.""

I closed my eyes.

It was worse than I imagined.

They had planned to use my daughter as leverage.

"Do you have proof?""

"Yes.""

"What kind?""

Megan took a breath.

"I have messages between Mom and Mark.""

"Send them to Rachel.""

"I will.""

Then she said something else.

"There's another reason I called.""

"What?""

"Mark has been telling everyone that you knew about the trust.""

I stared at the table.

"What?""

"He says you agreed to it months ago and are now denying it because the company is in trouble.""

"That's a lie.""

"I know.""

"Then why would he say that?""

"Because he has a recording.""

My blood went cold.

"What recording?""

"From a dinner last summer. You were talking about helping the family business.""

I remembered.

A dinner at Robert and Linda's house.

Mark had been discussing a new property development.

I'd said I was happy to help if the family needed anything.

That was all.

"He's going to use that?""

"Yes.""

I felt sick.

"Did he record me without telling me?""

"I don't know.""

Megan hesitated.

Then she whispered:

"Chloe, I think Dad has something much worse than a recording.""

"What?""

"A document saying you agreed to become the trustee.""

The following morning, Rachel arrived with a printed copy of Megan's messages.

She placed them on the table.

"These are useful.""

"Can they stop the custody hearing?""

"They help establish that the proposed custody action may be connected to the financial dispute. But we still need to prepare for the hearing itself.""

I looked at the messages.

Linda had written:

If Chloe won't cooperate, Mark needs to make her understand what she could lose.

Mark had replied:

I know. I'm handling it.

Then Linda:

Don't let her take Lily away from this family.

Rachel looked up.

"These messages need to be authenticated. Megan may need to provide a statement.""

I nodded.

"She said she'll cooperate.""

"Good.""

I hesitated.

"Rachel, could they really make me look like an unfit mother?""

"Anyone can make an allegation. That doesn't mean it's true.""

She closed the folder.

"Chloe, the most important thing is Lily's safety and stability. Keep her routine consistent. Don't discuss the case with her.

Don't speak negatively about Mark in front of her. And document every interaction.""

I nodded.

Then my phone rang.

It was the preschool.

I answered immediately.

"Hello?""

"Mrs. Bennett? This is Melissa, Lily's teacher.""

"Is everything okay?""

"Yes, but there's something you should know.""

My heart began beating faster.

"What happened?""

"Mr. Bennett came by this morning.""

I stood.

"Mark?""

"Yes. He asked to take Lily home early.""

I gripped the counter.

"Did you let him?""

"No. We followed the contact instructions on file.""

I closed my eyes.

"Thank you.""

Melissa hesitated.

"He was quite upset. He said there had been a family emergency.""

"What did he say to Lily?""

"Nothing. We kept her in the classroom.""

I exhaled.

"Thank you for calling.""

After hanging up, I immediately contacted Rachel.

"He went to the preschool.""

Rachel stood.

"Did he take Lily?""

"No.""

"Good. We need to update the school contact arrangements immediately and make sure they have the correct legal documentation.""

I nodded.

But before I could move, another message arrived.

It was from Mark.

You have until tomorrow morning to sign the acknowledgment. After that, I won't be able to protect you.

I stared at the screen.

Then another message appeared.

And if you think you can use Lily to punish me, you're about to discover how wrong you are.

Rachel read it over my shoulder.

Her expression hardened.

"Save that.""

I forwarded it.

Then I looked at her.

"He's threatening me.""

"He's trying to intimidate you.""

"What do we do?""

Rachel picked up her phone.

"We prepare.""

At 6:40 p.m., Megan sent another file.

It contained a screenshot of a conversation between Linda and Mark.

I opened it.

*Linda:* Has she signed yet?

*Mark:* No.

*Linda:* Then use the custody filing.

*Mark:* I'm already doing that.

*Linda:* Make sure she understands that Lily belongs with her father's family too.

I read the messages again.

Then I noticed another conversation beneath them.

It was between Mark and an unknown contact.

*Unknown:* What if she refuses even after the hearing?

*Mark:* Then we'll use the original authorization.

*Unknown:* Are you sure it's still valid?

*Mark:* It has her signature. That's all that matters.

I felt my hands go cold.

I forwarded the screenshots to Rachel.

A moment later, she called.

"Chloe, I need you to look at the last message again.""

I opened it.

It has her signature.

Rachel spoke slowly.

"There's a possibility Mark believes he has an original document bearing your genuine signature.""

"But he forged everything.""

"Maybe. Or perhaps he obtained something from you without your knowledge.""

I thought about the documents I'd given him over the years.

Passport applications.

Insurance forms.

Mortgage paperwork.

Then I remembered something.

The day Lily was born, Mark had asked me to sign several hospital forms while I was exhausted and recovering.

One of them had been a financial authorization.

I had never seen it again.

I told Rachel.

She went silent.

Then she said:

"Chloe, we need to obtain a copy of every document you've signed in the last six years.""

I stared at my phone.

Because suddenly, I understood something.

Mark might not have needed to forge every signature.

May you like

He might have had access to a genuine one.

And if that was true, the most important document in this entire case might be sitting somewhere in a file I had never seen.
